Terms & Conditions - Sharkout

By downloading or using the app, these terms automatically apply to you - please read them carefully before using the app. Monoshark grants you a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. You are not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app, translate the app into other languages, or make derivative versions. The app itself, and all trademarks, copyright, database rights, and other intellectual property rights related to it, belong to Monoshark.

By using the app you confirm that you are legally capable of entering into these terms, or that you have the consent of a parent or guardian.

Monoshark is committed to making the app as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you are paying for.

Health and Fitness Disclaimer

Sharkout is a tool for recording workouts. It does not provide medical advice, training advice, or health guidance of any kind, and nothing in the app should be treated as such. The app is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, illness, or health condition.

Consult a physician or qualified health professional before beginning or modifying any exercise program - especially if you are pregnant or nursing, have a heart condition, an injury, or any pre-existing or chronic medical condition. Stop exercising immediately if you feel dizzy, faint, short of breath, or in pain, and seek medical attention. Never disregard medical advice, or delay seeking it, because of anything recorded or displayed in the app.

Physical exercise carries inherent risks, including injury and death. By using the app you assume all such risks, known and unknown. Totals, charts, records, and other values the app calculates from your entries are estimates for informational purposes only and may be inaccurate. To the maximum extent permitted by applicable law, Monoshark accepts no liability for any injury, health condition, or damage arising from your training decisions or physical activity, whether or not they were recorded or planned in the app.

Your Data

The Sharkout app stores the data you enter locally on your device. It is your responsibility to keep your phone and access to the app secure, and to make your own backups of your data if you want to protect it. Deleting the app deletes its data; Monoshark keeps no copy of it and cannot restore it. We therefore recommend that you do not jailbreak or root your phone, which could compromise your phone's security and could mean the Sharkout app won't work properly or at all.

Files you export - a full backup, or a single plan - are yours to look after. If you send one to another device or to another person, you choose who receives it, and what happens to it afterwards is outside our control. Our Privacy Policy explains how the app handles your data, including the diagnostic reports you may choose to send us.

Limitation of Liability

The app is provided "as is", without warranty of any kind. While we strive to keep the app correct and reliable, to the maximum extent permitted by applicable law, Monoshark accepts no liability for any loss, direct or indirect, that you experience as a result of relying on the app or on the data recorded in it, including loss of data. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law.

Apple App Store

The app is distributed through the Apple App Store. You acknowledge that these terms are between you and Monoshark, not Apple; that Apple has no obligation to provide any maintenance or support for the app; and that Apple is not responsible for addressing any claim by you or a third party relating to the app, including any product liability claim, any claim that the app fails to conform to a legal or regulatory requirement, any consumer protection claim, or any third-party claim that the app infringes intellectual property rights. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) that you paid for the app; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app. When using the app, you must comply with any applicable third-party terms of agreement (for example, your wireless data service agreement). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.

Governing Law

These terms, and any dispute arising out of them or out of your use of the app, are governed by the laws of Ukraine, and the courts of Ukraine have jurisdiction over such disputes. If you are a consumer, you additionally keep the benefit of any mandatory consumer-protection rules of the country where you live, and nothing in this clause deprives you of them.

Severability and Entire Agreement

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. These terms, together with our Privacy Policy, constitute the entire agreement between you and Monoshark regarding the app.

Updates and Termination

At some point, we may wish to update the app. The app is currently available on iOS and macOS - the requirements for the system (and for any additional systems we decide to extend the availability of the app to) may change, and you'll need to download the updates if you want to keep using the app. Monoshark does not promise that it will always update the app so that it is relevant to you and/or works with the iOS version that you have installed on your device. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Changes to These Terms and Conditions

We may update our Terms and Conditions from time to time. You are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
